Swimlane is published by Berenger.dev SRL, a private limited liability company (SRL) incorporated under Belgian law, with its registered office at Rue Sainte Anne, Termes 8, 6813 Chiny, Belgium, registered under enterprise number 0787.693.448 (Register of Legal Entities (RPM) Liège, Arlon division), VAT BE 0787.693.448, reachable at hello@getswimlane.com (“we”).
These general terms and conditions (the “Terms”) apply to any use of Swimlane and to any purchase. The French version prevails, without prejudice to the rights of the Consumer; translations are provided for your convenience.
1. Definitions
- Service: the Swimlane application, its features, its public API and its webhooks.
- Organization: the workspace in which one or more members use the Service and share their data (contacts, lists, pipelines, campaigns).
- Customer: the natural or legal person who creates an Organization or purchases the Service for it.
- Member: any person who has access to an Organization, whatever their role (owner, administrator, member).
- Business Customer: the Customer who acts in the course of their commercial, industrial, craft or professional activity, including a self-employed person.
- Consumer: the natural person who acts for purposes that fall outside the scope of their professional activity.
- Customer Data: everything that you and your Members import, synchronize or create in the Service, in particular the data of the people you prospect (the “Prospects”).
- Subscription: paid access to the Service billed per period; Lifetime Offer: access to the Service acquired through a one-time payment (Article 10).
2. Acceptance and applicable documents
By creating an account, you accept these Terms. When you take out a Subscription or purchase the Lifetime Offer, you accept them again by ticking the box provided for that purpose. We keep a record of this acceptance and of the version accepted; the version in force can be consulted at any time on this page.
If you act on behalf of a company, you represent that you have the authority to bind it.
The following also form part of the contract: the Privacy Policy, the Cookie Policy and, for Customer Data, the Data Processing Agreement. In the event of a conflict concerning data protection, the Data Processing Agreement prevails. Special terms agreed in writing prevail over these Terms.
Swimlane is designed primarily for Business Customers. It may also be purchased by a Consumer: in that case, the provisions reserved for Consumers (in particular Article 13) and the mandatory consumer protection rules apply in addition to these Terms and prevail over them.
3. The Service
Swimlane is a CRM for prospecting on LinkedIn. Depending on the features available at the time of your use, it allows you, in particular, to:
- identify and import contacts (searches, interactions with posts, profile visitors, invitations received, suggestions);
- synchronize and manage your LinkedIn messaging;
- organize your contacts into lists, tags, notes, reminders and pipelines;
- automate sequences of actions (invitations, messages, “Likes” on the latest post, pokes, tags) according to conditions that you configure;
- obtain analyses and suggestions generated by artificial intelligence (Article 6);
- work as a team and connect other tools via the public API and webhooks.
The Service evolves. We may add, modify or remove features. If we remove an essential feature that you use, we will notify you at least 30 days in advance, unless the removal is required by law, by a security risk or by a third party such as LinkedIn. In all cases, Article 12 applies to that removal.
We do not guarantee any commercial result (number of replies, meetings or sales).
4. Account and Organization
- You must be at least 18 years old and provide accurate information.
- Each access is personal: a Member must not share their login credentials.
- You are responsible for keeping your login credentials confidential and for anything done from your account. Notify us without delay at hello@getswimlane.com in the event of unauthorized access.
- The owner of the Organization manages the Members and their roles, and is responsible for the use of the Service by the Members they invite.
5. Connecting your LinkedIn account
To function, the Service must access your LinkedIn account. You log in to LinkedIn from a login page that we host: your credentials are passed to a browser running on our servers, which opens the LinkedIn session in your place. Your password is not stored; the resulting session is stored in encrypted form so that the Service can act on your behalf. Traffic to LinkedIn goes through residential proxies, supplied by a specialized provider, whose exit points are located in the country and region you specify.
By connecting your account, you authorize us to view the information in your LinkedIn account and to perform in it the actions that you trigger or schedule.
You acknowledge that the use of Swimlane, in particular of its import, synchronization and automation features, may breach LinkedIn’s terms of use. LinkedIn may restrict, suspend or close your LinkedIn account, in particular if it considers that you are breaching its terms or policies. You accept this risk by connecting your account.
Swimlane is not affiliated with LinkedIn, nor endorsed or sponsored by LinkedIn. The Service spaces out its actions, respects your time windows and applies daily caps to limit this risk, without being able to eliminate it. We are not liable for measures taken by LinkedIn against your account or for the consequences of those measures, unless we are at fault.
LinkedIn may change its website at any time, which may temporarily interrupt certain features. You may disconnect your LinkedIn account at any time from your settings; the stored session is then deleted.
6. Artificial intelligence
Certain features (contact analysis, fit with your ideal customer profile, reply suggestions, opening messages, message templates used in campaigns, tone profile) rely on artificial intelligence models provided by the third parties listed on the Sub-processors page.
- Generated content may be inaccurate, incomplete or inappropriate. Check it before relying on it.
- If you configure a campaign with messages generated by artificial intelligence, those messages may be sent automatically, without prior review. You choose this mode of operation and you are responsible for the content sent in your name, including compliance with the obligations to inform recipients that are incumbent on you.
- We do not use Customer Data to train artificial intelligence models.
7. Acceptable use
You undertake not to use the Service to:
- send unsolicited bulk messages, or misleading, harassing, hateful or unlawful messages;
- process personal data without a legal basis, or special categories of data (health, political opinions, religion, sexual orientation, etc.);
- circumvent the limits, quotas and security measures of the Service;
- resell or sublicense the Service or make it available to third parties, or use it to develop a competing product;
- extract data from the Service by automated means other than the public API, test, overload or attack our infrastructure, or access another customer’s data;
- infringe the rights of third parties or break the law.
Your obligations regarding personal data. For Customer Data, you are the controller and we act as processor, in accordance with the Data Processing Agreement. It is your responsibility, in particular, to have a legal basis for prospecting each person, to inform them in accordance with Article 14 of the GDPR (at the latest at the time of your first message), to respect their objection and their other rights, and to comply with the rules applicable to commercial communications. The Service allows you to delete or export a contact at any time.
Reporting illegal content. Anyone may report to us illegal content stored in the Service by writing to hello@getswimlane.com, explaining why the content is illegal and where it is located, and providing their name and email address and a statement of good faith. We handle reports diligently and inform their author of our decision.
Moderation. We do not generally monitor Customer Data. When we restrict content or an account because of illegal content or a breach of these Terms, we give you the reasons, unless prohibited by law. You may challenge the decision at hello@getswimlane.com; your challenge is reviewed by a person, and not by an automated system.
8. Prices, invoicing and payment
- Subscription. The price is set per Member and per period (monthly or, where offered, annual). It is displayed excluding VAT and is payable in advance. The amount invoiced corresponds to the number of Members of the Organization; when that number changes, invoicing may be adjusted from the following period, after you have been informed.
- VAT. VAT or the applicable tax is added according to the rules in force for your situation (country of establishment, status as a Business Customer or Consumer, VAT number) and calculated at the time of payment: in particular, Belgian VAT for customers established in Belgium, the VAT of their country for Consumers in the European Union, and reverse charge for businesses established in another Member State that provide a valid VAT number. The price inclusive of all taxes that applies to you is displayed before you confirm payment.
- Payment. Payment is made by card through our provider Stripe. We never have access to your card details.
- Renewal. The Subscription renews automatically for a period of the same length until it is terminated (Article 11).
- Price changes. We may change the Subscription price for a valid reason (changes in our costs, in the Service or in taxation). We will notify you by email at least 30 days in advance; the new price applies from the following renewal, and you may terminate free of charge before it applies. The price of a Lifetime Offer already paid never changes.
- Invoices. Invoices are issued electronically and are available in the billing area.
- Input errors. Before you confirm payment, the payment page summarizes your order and allows you to correct your information.
9. Trial period
- Each Organization benefits only once from a free 7-day trial period, with all the features of the Subscription. It starts when the Organization is created.
- No payment card is requested for the trial and nothing is charged during it.
- The trial does not turn into a Subscription. When it ends, access to the Service is suspended until you take out a Subscription or buy the Lifetime Offer; you are charged nothing if you do neither.
- You may subscribe at any time during the trial; the Subscription then starts immediately and the first payment is charged on the day you subscribe.
- After the trial ends, your data is kept in accordance with Article 14.
10. Lifetime Offer
- The Lifetime Offer is a temporary offer, available for a period and, where applicable, for a number of Organizations, as indicated on the payment page. Its price, displayed excluding VAT, is paid only once.
- It gives access to the features of the Subscription and their updates for the entire lifetime of the Swimlane product, that is, for as long as Swimlane is operated, by us or by an acquirer. It does not exempt you from usage limits or from these Terms.
- It covers one Member. Each additional Member of the Organization is billed at the Subscription price per Member. An Organization that purchased the Lifetime Offer before 15 September 2026 keeps, at no extra charge, the Members it had on that date.
- It is attached to the Organization and may be neither transferred to another Organization nor resold.
- It is non-refundable, except where a Consumer exercises the right of withdrawal (Article 13) and except where mandatory law provides otherwise.
- If we stop operating Swimlane, we will notify you at least 60 days in advance. You may export your data during that period; at the end of it, accounts and data are deleted and the Lifetime Offer ends, without refund.
- If Swimlane is transferred, the Lifetime Offer is transferred to the acquirer together with the rest of the contract (Article 22).
11. Termination by the Customer
- You may terminate the Subscription at any time from the billing area. Termination takes effect at the end of the current period; access is maintained until then.
- Amounts paid for the current period are not refunded, unless Article 12 or Article 13 applies.
- After the Subscription ends, the Organization is deactivated (Article 14): your data is retained and you may subscribe again or delete your account.
- The owner of the Organization may at any time delete the account and all its data from the Organization’s settings. Deletion is permanent and ends all billing.
12. Quality of the Service and pro rata refund
We use our best efforts to ensure that the Service is available and works properly, without guaranteeing uninterrupted availability. Maintenance interruptions may occur; we announce them in advance when they are scheduled.
If the Service or one of its essential features is unavailable or unusable for a reason not attributable to you, and the problem is not resolved within 15 days of your report to hello@getswimlane.com, you may obtain a refund of the Subscription pro rata to the affected period, or terminate immediately and obtain a refund of the unused part of the paid period. This rule also applies when an essential feature becomes unavailable because of LinkedIn for more than 30 days. It does not apply to the Lifetime Offer.
13. Consumer’s right of withdrawal
If you are a Consumer, you have 14 days from the conclusion of the contract (taking out the Subscription, or the payment for the Lifetime Offer) to withdraw, without giving any reason.
How to withdraw. Use the “Withdraw from contract here” function, available in the application throughout the withdrawal period, in the billing area; you immediately receive an acknowledgment of receipt by email stating the content and the date and time of your withdrawal. You may also send us an unequivocal statement, for example using the model form below, to hello@getswimlane.com or by post to our registered office. You meet the deadline if you send your withdrawal before it expires.
Immediate performance. By ticking the box provided when you subscribe, without which subscription is not possible, you request that the Service begin immediately, during the withdrawal period. If you then withdraw, you owe us an amount proportionate to the service provided up to your withdrawal:
- nothing for the days of the free trial period;
- for the Subscription, the price of the period pro rata to the days of paid access;
- for the Lifetime Offer, an amount calculated pro rata to the days of access on the basis of the monthly Subscription price for one Member, never exceeding the price paid.
Refund. We refund the amounts you paid, less the amount above, no later than 14 days after receiving your withdrawal, using the same means of payment. Your withdrawal ends the contract and the paid access.

14. Non-payment and deactivation
- If a payment fails, our payment provider retries the charge and informs you.
- Until the payment is settled, the Organization is deactivated: access to the Service is suspended and automations are stopped, but your data is retained. Access is restored upon payment.
- A deactivated Organization may at any time regularize its situation or delete its account.
- An Organization that has been deactivated for more than 12 months is deleted automatically, together with all its data. We notify its Members by email at least 30 days before deletion.
15. Suspension and termination by us
We may suspend or restrict access to all or part of the Service in the event of a breach of these Terms, after inviting you to remedy it. We may do so immediately in the event of a serious breach or an emergency: a risk to the security of the Service or of other customers, manifestly illegal content, repeated complaints about unsolicited messages being sent, or fraud. We always give you the reasons for our decision.
If the serious breach is not remedied within 15 days of our notification, we may terminate the contract. Except in the case of a Consumer, the amounts paid are then retained by us.
16. Your data, its export and switching providers
Customer Data belongs to you. You may at any time export your contacts from the application (CSV format) and access your contacts, lists and companies via the public API.
In accordance with Regulation (EU) 2023/2854 (Data Act), if you wish to switch to another provider, switch to on-premises infrastructure or have your data erased, write to us at hello@getswimlane.com:
- Notice. The process starts no later than two months after your request.
- Transition period. For a maximum of 30 days, the Service continues to operate, and we help you retrieve your data and prepare the migration.
- Exportable data. You can retrieve all Customer Data in a structured, commonly used and machine-readable format (CSV or JSON): contacts and companies, lists, tags, notes and reminders, pipelines and stages, synchronized conversations and messages, interaction history, campaigns and their steps, message templates, audiences and ideal customer profile descriptions, as well as the data of your account and of your Members. Excluded are our source code, our score calculation parameters and our instructions to artificial intelligence models, which constitute our trade secrets.
- Retrieval. You then have at least 30 days to retrieve your data.
- Erasure. At the end of that period, your data is erased under the conditions set out in Article 9 of the Data Processing Agreement.
- Charges. Switching providers is free of charge.
The jurisdiction to which our infrastructure is subject and our measures against unlawful access by third-country authorities are described on the Sub-processors page.
17. Personal data
We process our users’ data as controller, in accordance with the Privacy Policy. We process Customer Data as processor, in accordance with the Data Processing Agreement, which forms part of this contract.
We may produce aggregated and anonymized statistics from the use of the Service, which do not allow you, your Members or your Prospects to be identified, in order to improve the Service.
18. Intellectual property
The Service, its code, its interfaces, its trademarks and its content belong to us or to our partners. We grant you, for the term of the contract, a personal, non-exclusive and non-transferable right to use the Service for the needs of your Organization.
You retain all your rights in Customer Data. You grant us the right to host, reproduce, process and display it solely to the extent necessary to provide the Service.
If you share suggestions with us, we may use them freely to improve the Service.
19. Liability
We are bound by an obligation of means (obligation de moyens). We are not liable for:
- indirect damage, such as loss of revenue, customers, opportunities or data that was not exported;
- measures taken by LinkedIn or by any other third party, unless we are at fault;
- the content that you create, import or send, or its compliance with the law.
For a Business Customer, our total liability, for all damage combined, is limited to the amount paid for the Service during the 12 months preceding the event giving rise to liability or, for the Lifetime Offer, to the price paid.
These limitations do not apply in the event of fraud, intentional misconduct or gross negligence on our part or on the part of persons acting under our authority, in the event of harm to life or physical integrity, or where the law prohibits them. They do not deprive the Consumer of the rights granted to them by law.
The Business Customer shall indemnify us against any claim by a third party (including a Prospect or LinkedIn) arising from its use of the Service in breach of these Terms or of the law.
20. Force majeure
Neither party is liable for a failure caused by an event reasonably beyond its control (widespread outage of an infrastructure provider, large-scale cyberattack, decision of an authority, disaster). If the event lasts more than 30 days, either party may terminate the contract; amounts paid in advance for the unused period of a Subscription are refunded.
21. Confidentiality
Each party keeps confidential the non-public information of the other party that it receives in connection with the contract, and uses it only for the performance of the contract. This obligation applies throughout the term of the contract and for three years after it ends.
22. Assignment
We may assign the contract to a third party that takes over the operation of Swimlane. The acquirer then succeeds to all of our rights and obligations towards you, including the Lifetime Offer; we will inform you of this. The Business Customer may not assign the contract without our prior written consent.
23. Amendments to the Terms
We may amend these Terms for a valid reason: changes to the Service, to the law, to case law or to our partners’ requirements, or security. We inform you of any material amendment by email at least 30 days before it takes effect. If you refuse the amendment, you may terminate free of charge before that date; for a Subscription, the unused part of the paid period is then refunded to you. Purely formal amendments, or amendments required by law, may apply immediately. An amendment may never remove the access acquired through the Lifetime Offer.
24. Governing law and disputes
These Terms are governed by Belgian law.
If a difficulty arises, first write to us at hello@getswimlane.com: we will seek an amicable solution.
If their complaint is unsuccessful, the Consumer may contact the Consumer Mediation Service (Service de médiation pour le consommateur), North Gate II, Boulevard du Roi Albert II 8 box 1, 1000 Brussels (mediationconsommateur.be). The Consumer retains the protection afforded by the mandatory provisions of the law of the country in which they habitually reside and may bring proceedings before the courts designated by law, including those of their domicile.
For Business Customers, any dispute falls within the exclusive jurisdiction of the courts of the judicial district of Liège, Arlon division.
25. Final provisions
If a clause is held void or unenforceable, the other clauses remain in force and the clause concerned is replaced by a lawful clause whose effect is as close as possible. Failure to invoke a clause does not constitute a waiver of it. These Terms and the documents referred to in Article 2 constitute the entire agreement between the parties on their subject matter.
